Website and Mobile App Terms of Use

Agreement

By using https://anthonyspaintingapp.com and the Anthony's Paintingmobile application (together, the "Services"), you agree to these Terms of Use. If you do not agree, please do not use the Services.

These Terms govern your use of the website and app. Your signed project agreement, approved estimate, change orders, warranty documentation, and related project documents control the specific terms of any painting or remodeling work we perform for you.

The Services

The Services provide information about Anthony's Painting and Remodeling, our services, project examples, tools to request estimates, customer accounts, scheduling, private project updates, Smart Measure features, electronic approvals, and portfolio content. Content on the Services — including project photos, videos, reels, and example scopes — is for illustration and marketing unless otherwise stated in a signed agreement.

Estimates and quotes

Submitting an estimate request or receiving a preliminary quote through the Services does not create a binding contract. A project begins only after both parties agree to a written scope, price, schedule, and any required approvals.

Preliminary pricing may change after inspection, measurements, surface-condition review, material selections, scope changes, or discovery of hidden conditions. Website or app examples and project videos do not guarantee identical results in every property.

When we confirm your estimate appointment, we may text the phone number you provided with scheduling details and a claim code you can use to link your project in the app. Downloading the app and creating an account are optional for receiving our services, but the app is how you access your private project feed, updates, and in-app consent controls.

Claim codes are issued for your project only. Do not share your claim code with others. How we handle account and messaging data is described in our Privacy Policy.

Service area

We primarily serve Amarillo and surrounding areas. We reserve the right to decline projects outside our service area or outside our scope of work.

Account security

When you create or use an account, you agree to:

• Provide accurate account and contact information
• Protect your login credentials and device access
• Protect your project claim codes and not share them with unauthorized people
• Not allow others to access your private project account without permission
• Promptly notify us if you suspect unauthorized access to your account

You are responsible for activity that occurs under your account unless you have notified us of unauthorized access and we have had a reasonable opportunity to act.

Acceptable use

You agree not to:

• Attempt unauthorized access to the Services, accounts, or data
• Scrape, copy, or redistribute website or app content without written permission
• Copy or redistribute project media without permission
• Use another customer's claim code or impersonate another person
• Upload unlawful, harmful, fraudulent, or infringing content
• Disrupt the website, app, database, authentication, or security systems
• Reverse engineer the Services except where prohibited by applicable law
• Use automated tools to overload, scrape, or misuse the Services in ways that interfere with normal operation

User-uploaded content

You may submit photos, project details, addresses, notes, messages, and estimate information through the Services. You confirm that you have the right to submit that information and that it is accurate to the best of your knowledge.

You retain ownership of your personal photos and content. By submitting content, you grant Anthony's Painting and Remodeling a limited permission to use it only as needed to prepare estimates, communicate with you, perform services, document projects, provide support, and comply with legal obligations. We do not claim ownership of your personal photos.

Electronic signatures and records

To the extent permitted by law, electronic signatures, approvals, acknowledgments, consent selections, and records submitted through the Services may be treated as written records and signatures.

Your signed project agreement controls project-specific terms. Electronic approval through the Services does not replace any legally required document unless permitted by applicable law.

Account suspension and termination

We may suspend or terminate access to the Services if we reasonably believe you have engaged in fraud, claim-code misuse, unauthorized access, harassment, security threats, illegal activity, or a material violation of these Terms.

Suspension or termination of app or website access does not automatically cancel payment obligations, warranty coverage, project work, or contractual duties under your signed project agreement.

Project content

Published project reels, photos, and walkthroughs on the Services show completed work examples we have permission to share publicly. Content is work-focused — documenting painting and remodeling results — not personal household details.

• Public project shorts and galleries do not include private client account data
• Nothing on the Services replaces or exposes your private in-app project account or job-site feed
• Do not copy, scrape, or redistribute Services media without our written permission

Media permission and consent

Marketing and portfolio use of project photos or videos requires client permission — through the in-app signed Showcase Our Work Permission flow, a written agreement, or other documented consent.

• Clients may choose Photos + Video, Photos Only, or No Media Use for how their project may be showcased
• Permission can be updated or revoked through the Anthony's Painting app or by contacting us directly
• If you decline media use, private job documentation stays within the project relationship unless you separately agree otherwise

How we collect, store, and protect project media is described in our Privacy Policy.

Intellectual property

The following remain owned by Anthony's Painting and Remodeling or its licensors:

• Website and app design, branding, logos, and written content
• Original project reels, beats, audio, editing sequences, and graphics
• Software, Smart Measure workflow, and portfolio presentation

You may view public content for personal, non-commercial purposes. You may not commercially copy, repost, resell, scrape, or redistribute our content or software without written permission.

Third-party services

The Services may rely on third-party hosting, mapping, authentication, messaging, analytics, app-store, payment, and communication services — including Firebase, Stripe, Google, Apple, Expo, and Vercel.

Third-party services may have their own terms and privacy policies. We are not responsible for third-party services we do not control.

Service availability

The website and app may occasionally be unavailable for maintenance, updates, or reasons outside our control. Features may be updated, changed, suspended, or removed over time. We do not guarantee uninterrupted or error-free access, but we make reasonable efforts to protect and maintain the Services.

Warranty

Any workmanship warranty applies only as described in your signed project agreement and depends on scope, surface condition, prep, product system, and maintenance. Services content does not modify or extend warranty terms.

Disclaimer

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of any kind regarding the Services and their content.

Limitation of liability

To the fullest extent permitted by law, Anthony's Painting and Remodeling shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

Privacy

Our collection and use of personal information is described in our Privacy Policy. Account deletion options are described on our Delete Account page.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise or provides you with rights that cannot be waived by contract.

Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

These Terms, together with our Privacy Policy, govern your use of the website and app. Project-specific work is governed by your signed estimate, contract, change orders, warranty, and related project documents.

Changes

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
